Terms of Service

These Terms of Service (the “Terms”) are a binding agreement between you and Petska (“Petska,” “we,” “us,” or “our”) and govern your access to and use of the Petska applications, websites, and related services (together, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

You must be at least 18 years old and able to form a binding contract to use the Service. If you use the Service on behalf of a business, you represent that you are authorized to accept these Terms for that business.

Petska supports two kinds of accounts: sitter accounts for pet-care providers who run their business on Petska, and client accounts for the pet owners they serve. You are responsible for the information you provide, for keeping your login credentials secure, and for all activity that occurs under your account. Tell us promptly at support@petska.app if you suspect unauthorized use.

You may register with an email and password or through a third-party sign-in provider (such as Google or Apple). If you sign in through a provider, you authorize us to access the basic profile information they make available, as described in our Privacy Policy.

Petska is software that helps independent pet sitters manage scheduling, client communication, visit report cards, and invoicing. Petska is a tool for running a pet-care business — we are not a party to any agreement between a sitter and a client, we do not provide pet-care services, and we do not employ or supervise sitters. Any arrangement for pet care, its quality, pricing, and payment is solely between the sitter and the client.

You agree not to:

• use the Service for any unlawful purpose or in violation of these Terms;
• upload content you do not have the right to share, or that is harmful, deceptive, or infringing;
• attempt to access accounts or data that are not yours, or probe, scan, or disrupt the Service or its infrastructure;
• reverse engineer or resell the Service except as permitted by law.

You retain ownership of the content you add to Petska — including pet and client details, notes, and photos (“Your Content”). You grant Petska a worldwide, non-exclusive license to host, store, process, and display Your Content solely to operate and improve the Service for you, including generating visit report cards. You are responsible for having the necessary rights and permissions for Your Content, including consent to store information about your clients and their pets.

Petska can use automated and AI systems to help draft visit report cards from the photos and notes you provide. AI-generated text may contain errors or omissions and is offered as a starting point. You are responsible for reviewing any report card before sending it to a client, and you remain accountable for the communications you send through the Service.

Some features of the Service may require a paid subscription. Where fees apply, they will be described at the point of purchase. Unless stated otherwise or required by law, fees are non-refundable. We may change our fees prospectively with reasonable notice.

You may stop using the Service and delete your account at any time from within the app. We may suspend or terminate your access if you violate these Terms or if we reasonably believe it is necessary to protect the Service or other users. On termination, the rights granted to you under these Terms end, and we may delete your account and content in accordance with our Privacy Policy and applicable law.

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

To the fullest extent permitted by law, Petska will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid Petska in the twelve months before the claim or one hundred U.S. dollars (US$100).

You agree to indemnify and hold harmless Petska from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, Your Content, or your violation of these Terms or the rights of any third party.

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and may ask you to re-accept the Terms within the app before you continue using the Service. Your continued use after an update means you accept the revised Terms.

These Terms are governed by the laws of the State of [STATE], United States, without regard to its conflict-of-laws rules. The exclusive venue for any dispute that is not subject to arbitration or small-claims court will be the courts located in [STATE].
